Terms and Conditions

Welcome to Silver State Media By booking, purchasing, or using our real estate photography, videography, drone, and related media services, you ("Client," "you") agree to the following Terms and Conditions. Please read them carefully.
1. Services Provided
Silver State Media provides professional real estate media services including, but not limited to:
- Photography
- Videography
- Drone imagery (where legally permitted)
- Floor plans
- Virtual tours
- AI-enhanced or virtual staging services
All services are intended for marketing and promotional use related to real estate listings unless otherwise agreed upon in writing.
2. Scheduling & Booking
- All appointments must be scheduled in advance.
- Booking confirmation is not guaranteed until acknowledged by Silver State Media.
- The Client is responsible for ensuring property access at the scheduled time.
3. Property Readiness
The Client is solely responsible for ensuring the property is fully ready for photography and/or videography at the scheduled appointment time.
Checklist Requirement: Silver State Media provides a pre-shoot preparation checklist. The Client must send this checklist to their homeowner, seller, or responsible party prior to the scheduled service to ensure the property is properly prepared. Failure to review or distribute the checklist does not waive any fees or policies outlined in these Terms and Conditions.
A property is considered not ready if, but not limited to:
- The home is not cleaned or staged
- Personal items, clutter, or construction materials are present
- Utilities are off or lighting is inadequate
- Occupants, pets, or vendors interfere with the shoot
- The Client or homeowner requests additional time upon arrival
If the property is not ready at the scheduled time, Silver State Media reserves the right to:
- Leave the property
- Proceed with limited coverage at our discretion
In all cases, the full service fee will still be charged. A reshoot will require a new booking and additional fees.
4. Cancellation & Rescheduling Policy
- Cancellations or reschedules must be made at least 24 hours prior to the scheduled appointment.
- Cancellations made within 24 hours of the appointment will incur a $50 cancellation fee.
- If the Client cancels while Silver State Media is already on-site or en route to the property, a $50 cancellation fee plus a fuel/travel charge will be applied.
5. Fees & Payments
- Payment is due upon receipt of invoice unless otherwise agreed upon in writing.
- Late payments may result in delivery delays or additional fees.
- Prices are subject to change without notice.
6. Editing Style & Revisions
- Silver State Media performs all editing in-house using our established professional style.
- By booking services, the Client acknowledges and agrees to Silver State Media’s creative approach, color grading, composition, and overall editing style.
- Requests to alter or customize editing style to match individual agent preferences will not be accommodated.
- Minor technical corrections (such as exposure or straightening) may be made at Silver State Media’s discretion.
7. Delivery & Turnaround Times
- Standard delivery timelines will be communicated at booking.
- Turnaround times may vary based on project scope, volume, or unforeseen circumstances.
- Rush services may be available for an additional fee.
7. Copyright & Usage Rights
- Silver State Media retains full copyright ownership of all media produced.
- Upon full payment, the Client is granted a limited, non-transferable license to use the media for marketing the specific property.
- Media may not be sold, transferred, reused for another listing, or altered without written permission.
Silver State Media reserves the right to use media for portfolio, website, social media, and promotional purposes unless otherwise requested in writing prior to the shoot.
8. Drone Services
Drone services are subject to:
- FAA regulations
- Airspace restrictions
- Weather conditions
- Safety considerations
Silver State Media reserves the right to refuse or cancel drone operations if conditions are deemed unsafe or unlawful. Drone cancellations do not automatically qualify for refunds.
9. Liability
- The Client agrees to ensure a safe working environment.
- Silver State Media is not responsible for damage caused by homeowners, occupants, pets, or third parties.
- Silver State Media is not liable for circumstances beyond our control, including but not limited to weather, property conditions, or access issues.
10. Indemnification
The Client agrees to indemnify and hold harmless Silver State Media from any claims, damages, or liabilities arising from the use of the media, property conditions, or failure to obtain necessary permissions.
11. Refund Policy
Due to the nature of digital media services, all sales are final once services have been rendered. No refunds will be issued for dissatisfaction based on personal preferences.
12. Agreement
By booking services with Silver State Media, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
